General rental conditions

1-1 APPLICATION


These general conditions apply to rental transactions concluded with the guests for the property located in Via per Binda 8 in Stresa (VB), named “Villa Virginia Luxury”.


1-2 GENERAL INFORMATIONS AND TERMS


The good conditions of the property make it suitable to be leased; the same real estate complies with current regulations on security and urban planning;

The property is in optimal conditions of conservation and maintenance;

The property is furnished and equipped with all the necessary accessories for tourist use. Villa Virginia Luxury also offers at its own expense, before and after each stay, cleaning and supply of linen (weekly change), garden and pool maintenance;

that it is intended to rent for tourist use Villa Virginia Luxury for stays each of not less than 7 days in high season (from May to October) and not less than 4 in low season (November to April) and not more than thirty days;

that during the rental period it is guaranteed that Villa Virginia Luxury will be free from people, things and animals that cannot be considered as accessories to the use of the property by third parties.

All this being said, Villa Virginia Luxury, in the person of its owner, will undertake to enter into a contract for tourist use with less than 30 days with customers to formalize the reservation of the property.

The client is expected to pay the 50% in advance payment as booking confirmation if it is a current year booking; 30% in advance payment if the reservation is for the following year.

The balance of the stay must be paid no later than 60 days before the date of the stay with the receipt of the payment.

The fee will not include the tourist tax and any extra charges that will be paid on site.

Services included in the rate: water, gas, air-conditioning, weekly cleaning, supply of bathroom and bedroom linen, supply of pool towels (weekly change), satellite TV, Wi-Fi, dishwasher, dryer, washing machine, baby cot and high chair, park, barbecue, parking place, safe, heated pool with Jacuzzi area for the exclusive use of Villa Virginia Luxury guests, tennis court also suitable as volleyball court, soccer field or bowling alley, Chapel (service in shared use with Villa Virginia Superior).

Not included: € 1.000 by bank transfer the day before the arrival is required as a security deposit for any damage; it will be refunded within 48 hours after the departure, after a Villa inspection

Tourist Tax;

Pets are not allowed

Smocking is forbidden inside the building

Parties, loud music or noise complaint are not allowed after 10:00 p.m. 

Check-in/ Check-out times will be as follows:

  • Check-in: from 03:00 p.m. to 06:00 p.m. (15:00-18:00), except for variations due to cleaning needs. 
  • Check-out within 11:00 a.m.

1-3 UNDERTAKING


The customer undertakes to respect and enforce all the provisions contained in the General Rental Conditions, as well as the legal and regulatory provisions. These rental conditions could be modified at any time and the applicable conditions will be those in force on the date on which the booking is confirmed.


1-4 LEGAL CAPACITY


Each customer of Villa Virginia Luxury declares to have legal capacity to act, which means be over the legal age (18 years) and not be under guardianship. 


1-5 PRICE


Prices are quoted in Euros (€). The VAT is always included, unless otherwise stated. The prices include in the rate only the free services and those services specified in the reservation. At the time of invoicing, the price indicated in the booking will be added to any additional services provided by the property during the stay and any tourist tax. The prices shown on the website may be changed without notice and only the price indicated in the booking confirmation is contracted.


1-6 CANCELLATION/ BOOKING CHANGE


In the event that, within ten days from the signature of the rental agreement the Customer should cancel the booking, no amount of money will be refund. 

However, in the event that the customer would require to cancel the reservation more than ten days after signing the agreement, will be refunded:

  • 10% of the rent for cancellations required within 4 months before the beginning of the lease;
  • 40% of the rent for cancellations required within 2 months before the beginning of the lease;
  • 100% of the rent for cancellation other than the previous ones. 

In the event that the reservation is cancelled due to demonstrable force majeure (e.g. by medical documentation), will be issued a voucher of the value of the amount to be used within 365 days from the date of its issue.  


1-7 PAYMENT METHODS


Only payments by bank transfer are permitted.

1-8 FORCE MAJEURE


Force majeure means any event external to the parties with an unpredictable and insurmountable character, which prevents either the customer or Villa Virginia Luxury from fulfilling all obligations under the contract or a part thereof. It is so in the case of prohibitions promulgated by government authorities.

It is expressly agreed that force majeure suspends the mutual enforcement of contractual obligations and that each contracting party bears the cost and expenses incurred. Customer will only bear any additional costs incurred to allow the onward journey, following the occurrence of a case of force majeure. 


1-9 INSURANCE – RESPONSIBILITY


Villa Virginia Luxury declines all liability in case of theft, loss or damage to the personal effects of the customer during his stay. The customer will be held liable for any damage, deterioration or vandalism that may occur due to the occupation of the premises and/or because of the participants and/or personnel for which he is responsible, movable assets, decorative and real estate property belonging or not to the Villa. 


1-10 STAY


In accordance with Italian law, the customer will be invited to show an identity document upon arrival at the Villa. The personal details of the guests staying will be transmitted to the Police, for public security purposes, to fulfil the obligation provided by the “Consolidated text of the laws of public security” (article 109 R.D. 18.6.1931 n. 773).

The client accepts and undertakes to use the Villa as a good family man. Any conduct contrary to good morals and public order will lead the owner to claim compensation for any damages. 


1-11 PRIVACY POLICY


Your data will be processed in accordance with current legislation on the protection of personal data (EU Regulation no. 679 of 2016). At the time of check-in, the customer will be subjected to the full information and will decide what purposes related to privacy give his consent.


1-12 APPLICABLE LAW


Any complaint, to be taken into account, must be made at the Structure within a period of 10 days from the date of stay. 

Jurisdiction for any dispute arising from this contract is the Court of Verbania and expressly the parties indicate that this contract must be understood as governed by Italian law.
